    A franchise agreement ties him into the franchisor – he must do business as the franchise agreement dictates – that means purchasing supplies from them or their supplier, doing accounting as they do it, there are all sorts of things in a franchise agreement – including a franchise fee. By just opening his own business, he is free to do business as he likes, free to choose his suppliers, and he doesn’t have to pay a franchise fee.
